These Mobile Messaging Terms & Conditions (“Mobile Terms”) govern participation in Validiform mobile messaging programs. By opting in to receive text messages, you agree to these Mobile Terms, our Privacy Policy, and any applicable Terms of Service.

Message Type:
Recurring transactional and informational text messages, which may include order or account notifications, customer service responses, appointment or delivery updates, and service-related communications. These messages do not include promotional marketing content.

Opt-In:
Users may opt in by submitting their mobile number through a Validiform web form or customer interaction where transactional text communication is reasonably expected. Consent is not a condition of purchase.

Message frequency varies based on account activity.

Message and data rates may apply.

Opt-Out:
To stop receiving messages, text STOP to 253-697-0380. Additional opt-out commands include QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL.

WARRANTY DISCLAIMER

Text message delivery is subject to effective transmission by your wireless service provider. Validiform does not guarantee uninterrupted or error-free delivery and is not liable for delays or failures in message transmission.

PRIVACY

We respect your privacy. Information collected in connection with our mobile messaging programs is used to deliver text messages and operate the programs. We may disclose information as required by law, regulation, or legal process, or to protect our rights or property. Please review our full Privacy Policy for additional information.

DISPUTE RESOLUTION & ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Mobile Terms or the mobile messaging programs shall be resolved through binding arbitration, except where prohibited by law.

Administrator: JAMS
Governing Law: Federal Arbitration Act (9 U.S.C. §§ 1–16) and Florida law (excluding conflict-of-law rules).

Arbitration Costs:
Validiform will pay arbitration filing fees in excess of the amount you would pay to file a lawsuit in court, unless the arbitrator determines the claim is frivolous.

Class Action Waiver:
All claims must be brought on an individual basis only. You waive any right to participate in a class, collective, or representative action.

Jury Trial Waiver:
If a claim proceeds in court, both parties knowingly and voluntarily waive the right to a jury trial.

MISCELLANEOUS

If any provision of these Mobile Terms is found unenforceable, the remaining provisions will remain in full force. Validiform reserves the right to modify these Mobile Terms at any time. Continued participation in a mobile messaging program after changes constitutes acceptance of the revised terms.
